This Ordinance Summary is published in accordance with the provisions of Government Code Section 25124. On May 9, 2024, the Board of Directors of the Cambria Community Services District adopted Ordinance 01-2024 adding Chapter 1.14 to the Cambria Community Services District Municipal Code relating to Civil Administrative Citations. Ordinance 01-2024 was adopted by the following vote:

Ordinance 01-2024 will add a new Chapter to the CCSD Municipal Code for a Civil Administrative Citation Program to provide for issuance of Civil Administrative Citations, which are in addition to all other legal remedies, criminal or civil, which the District may pursue to address a violation of the Cambria Community Services District Municipal Code.  Civil Administrative Citations will apply to a violation of any provision, restriction, or requirement of District Municipal Code or any code adopted by reference, any ordinance of the District, and any rule or regulation promulgated pursuant thereto. Cambria Community Services District Municipal Code Chapter 1.14 is authorized pursuant to Government Code Sections 53069.4 and 61064.

The Ordinance includes procedures relating to issuance of Notices of Violation and their contents, and Civil Administrative Citations and their contents. In addition, the Ordinance includes procedures for the administrative and summary abatement of public nuisances and code violations.  It includes provisions relating to fines for Civil Administrative Citations, which are established by a resolution of the Board of Directors, subject to certain maximum amounts set forth in the Ordinance, which are in accordance with Government Code Section 53069.4. Additional provisions are included relating to payment of fines and collection of fines by the District, as well as recovery of abatement costs.

As required by Government Code Section 53069.4, a process for contesting Civil Administrative Citations and seeking an administrative hearing has been included in the Ordinance, and procedures for such hearings. Prior to an administrative hearing, the Ordinance requires that the fine be remitted in advance, however, a procedure is included to allow for a hardship waiver of that requirement. Also, as required by Government Code Section 53069.4, anyone aggrieved by a decision of the hearing officer may seek judicial review in San Luis Obispo County Superior Court.
